Enforcement of Building Control Regulations
Enforcement of the Building Regulations 2000
A Local Authority has powers under the Building Act 1984 to taken enforcement action for non-compliance with the Building Regulations 2000. Under these powers the owner of a property or the builder can be taken to the Magistrates Court and if found guilty can be fined for the non-compliance, make to correct the works and also have to pay costs.
At Cannock Chase Council we have had very few cases that have resulted in court proceedings as the works have normally been corrected prior to this stage. However unfortunately enforcement action is sometimes necessary to ensure that building works are completed to a safe standard.
- Successful prosecution by Bath & North East Somerset Council's Building Control section - 31/01/2006.
