Smoke Control
The entire District is subject to a Smoke Control Order made under the Clean Air Act 1993. This helps to improve air quality both locally and nationally.
The occupier commits a criminal offence if smoke is emitted from a chimney on their building. The only exemptions are if:
- An authorised fuel is being burned, often called a smokeless fuel. Gas, anthracite, semi-anthracite, oil, and low volatile steam coal may also be burned providing you have the relevant appliance.
- Fuel is being burned on an exempt fireplace, often called an exempt appliance. These can be expensive to buy and install but allow fuels such as wood to be burned.
The maximum penalty upon summary conviction is £1,000. This law does not apply to outdoor appliances such as barbecues, chimineas, fireplaces or pizza ovens or to bonfires.
The occupier also commits a criminal offence if dark smoke is emitted from a chimney on their building. The maximum penalty upon summary conviction is £1,000 for dwellings and an unlimited fine in any other case.
