The Council has powers to deal with smells from industrial, trade or business premises as a statutory nuisance under the Environmental Protection Act 1990. You can read more about how the Council deals with statutory nuisances here.
If the premises are subject to an Environment Permit, any problems with smells will usually be dealt with through the conditions attached to the Permit rather than as a statutory nuisance. Some Environment Permits are regulated by the Council, others by the Environment Agency.
