Local Land Charges Update & COVID-19
The Local Land Charges team are continuing to operate a service as close to normal as possible, while following all the latest guidance.
Our staff are continuing to work from home and as part of our efforts to maximise the amount of time available to process search requests we are trying to minimise the interruptions to our service delivery.
As part of this approach, It should be noted that at present under the ongoing pandemic situation, telephone calls will not be responded to, therefore would you please email email@example.com and someone will reply via email.
Payments can be made by card. You can do this by calling our Contact Centre on 01543 462621 and then hold to speak to an Advisor. When speaking to an advisor, please ensure that you state that you would like to make a payment for a Local Land Charges search.
All searches are processed in strict date order in fairness to everyone but please note that we are currently receiving a high volume of search requests and longer waiting times can be expected.
We can assure you that we are endeavouring to reduce our turnaround times but information from other organisations is taking longer than anticipated and ultimately this has an impact on our responses to you.
We are currently still unable to offer facilities to enable a personal inspection of the Local Land Charges Register but as a temporary measure we will continue to book appointments and will email information out on the day of the pre-booked appointment.
What is a Search?
A Search is carried out to ascertain if there are any matters affecting the property or land registered as a Local Land Charge, which an intended purchaser should be aware of (LLC1). It also reveals other relevant information held by the Council as a whole (CON29). The information given on a Search relates only to the property identified by the Search address and accompanying plan, which should be edged in red.
A Search is divided into two parts. The first part, the LLC1, deals with all registrable charges, for example Planning Permissions, Conservation Areas, Tree Preservation Orders, Listed Buildings etc. The second, the CON29, deals with additional enquiries, including such matters as Local Plan Status, Road Schemes, Contaminated Land, Building Regulations etc.
All drainage enquiries on a Search are now conducted by Severn Trent Water Searches.
Highways questions which are answered by Staffordshire County Council are contained in the CON29 part of the Official Search. Additional enquiries regarding highway issues should be directed to the authority by the person, company or firm carrying out the Search. Welcome to Cannock Chase Council Local Land Charges Section. Here we aim to provide information with a guide to Searches, Fees and other relevant information regarding the Search process.
We are a small section of 2 part-time staff and we process approximately 3,000 Searches per year.

Terms and Conditions
When submitting a Search, please ensure it is accompanied by a cheque for the full amount payable to Cannock Chase Council. Please note that if any cheques are dishonoured the Search will not be dispatched. The organisation or individual presenting a cheque which is dishonoured will in future have to wait while any cheque is cleared before the Search is processed.

Please submit 2 plans with your Search and the postcode of property if known.

How to Access CON29 Information
This guide has been produced to help our customers access CON29 information, giving details of how and where to obtain the relevant answers. Some information is available from Public Registers, although appointments need to be made with the appropriate department.
Local Land Charges Register
An LLC1 Search covers the information held on the Local Land Charges (LLC) Register and can be purchased directly using the Search Request Form, the current fee being £31.16 (Residential) and £48.16 (Commercial) – Non Vatable.
The LLC Register is a public register which may be inspected by anyone wishing to do so. There is no charge for this.
A search of the Local Authority records can help to protect potential purchasers. It lets them know if there are any restrictions, agreements or proposals which may affect the property or land.

Planning Public Register
Data held on the above register can be purchased through LLC by using the Search Request Form. The current fee for questions 1.1 (a-i) for residential properties is £6.84 (£5.70 plus £1.14 VAT).
This Register contains details of all Planning Applications and decisions under planning legislation. If you require an appointment to view only the Planning Public Register contact the Planning Section, Development Control on 01543 462621.
Enforcement & Tree Preservation Order Public Registers
Data held on the above registers can be purchased through LLC by using the Search Request Form. The current fee for question 3.9 (a-n) for residential properties is £1.56 each (£1.30 plus £0.26 VAT).
These registers contain Enforcement Notices, Stop Notices, Breach of Condition Notices and Tree Preservation Orders.

The Enforcement Register is available upon request at the main reception at the Civic Centre.
Please note: Not all the questions under 3.9 on the CON29 will be obtained from Public Registers.
Community Infrastructure Levy (CIL)
Cannock Chase Council have a CIL charging schedule. The current fee for questions 3.10 (a-h) is FOC at present but will be reviewed in the near future.
Assets of Community Value
There is no fee for questions 3.15 (a (i)-(v) & b (i-iii).

Staffordshire County Council is responsible for all adopted highways within Cannock Chase District.
To obtain details of adopted highways information held in the public register you will need to contact Staffordshire County Council, 2 Staffordshire Place, Tipping Street, Stafford ST16 2DH. Telephone: 0300 111 8000.
Please contact Staffordshire County Council direct for answers to the relevant CON29 questions under 2.1, 2.2, 2.3, 2.4, 2.5, 3.2, 3.3, 3.4, 3.6, 3.7e & g and 3.12 (part).
To purchase a reply directly from Staffordshire County Council complete a Highway Search Enquiry Form obtained from www.staffordshire.gov.uk. A fee will be charged for this information.
The relevant CON29 question, 1.2 can be purchased through LLC by using the Search Request Form. The current fee for residential properties is £5.04 (£4.20 plus £0.84 VAT).
The Local Plan can be viewed in hard copy at the main reception at the Civic Centre or obtained from www.cannockchasedc.gov.uk/planning
Contaminated Land Register
Data held on the above register can be purchased through LLC by using the Search Request Form. The current fee for question 3.13 (a-c) for residential properties is £1.26 each (£1.05 plus £0.21 VAT).
Information regarding the Contaminated Land Register can be obtained from Environmental Health, on 01543 462621.
There are several ways to obtain radon gas information:
The relevant CON29 question, 3.14 can be purchased through LLC by using the Search Request Form. The current fee for residential properties is £1.26 (£1.05 plus £0.21 VAT)
Searches can be carried out via the UK Radon website, www.ukradon.org and the Health Protection Agency (HPA) website, www.hpa.org.uk/radiation. A fee will be charged for this service.
All the remaining questions on the CON29 can only be purchased through LLC by using the Search Request Form. Please refer to the request form for details of the individual fees.

To purchase a full Residential Search (LLC1 & CON29) the current fee is £101.36

Note: To ensure fairness to all our customers, individual CON29 enquiries will be dealt with the same as a full Local Authority Search and payment must be made at the time of making a request for information. Requests will not be processed until payment has been received and replies will be posted to customers. We are committed to providing replies within 10 working days for standard enquiries.
